Anatomy of a trademark.com Lawsuit

While this isn't breaking news, it is interesting nonetheless.

Be careful, though. If you get sucked in by the introduction, you may end up reading the whole drama. As the lawyers probably know, the lawsuit story is always long. This is no exception. The defendant's account of the story is 115 Acts!

He registered http://shopsatwillowbend.com/ to praise "The Shops at Willow Bend." The owner of the mark "The Shops at Willow Bend" was unhappy with this registration, but ultimately lost the trademark dispute. I can't tell you why he won, since I only read the condensed version of the ordeal, but I'm guessing it may involve the prominent disclaimer on his site and the evolving law of "gripe sites."

Maybe I'll read the entire saga to find out the reason. Or, maybe I'll just wait until I can catch the movie locally.
