mary kay patent infringement - update

Pink CadillacWow!  Mary Kay folks are Google crazy. 

Last week I dropped a link in one of the PHOSITA ::: quick links about the recent $26 million judgement TriStrata extracted from Mary Kay for patent infringement and – bam! – Google is sending a flood of pink Cadillac surfers my way. 

 

 

In order to keep the folks happy — here is a link to the TriStrata v. Mary Kay Jury Verdict Form (PDF 217 KB). 

TriStrata Technology Inc. is a subsidiary of NeoStrata Co. Inc. 

According to Jan Conlin, one of TriStrata’s lawyers:

"This five-day trial was a swift conclusion to a four-year patent battle.  We are extremely pleased the jury recognised Mary Kay's infringement and awarded TriStrata with this substantial verdict."

The jury ruled that the three TriStrata wrinkle cream patents in question (U.S. Patent Nos. 5,091,171, 5,422,370 and 5,547,988) were valid and that Mary Kay infringed these patents by using the alpha-hydroxyacid skin care technology without permission.

Ouch! I admit, I'm a consultant for Mary Kay. However, I can't figure out which products these were! I'd like to know, because if I still have them, I'm going to write them off as bad product and not sell them anymore. I can't support violating another company's hard work. We need to respect our peers in the industry.

I'm a Sr. Sales Director with Mary Kay. Been in the business for 10 years now, and MK does not have ANY products with alpha hydroxy ingredients in the line. There are more advanced, gentler ingredients now. If you'd like to browse our line of products go to www.marykay.com/ablevins .
