XBOX ALLEGEDLY INFRINGES MAGNET PATENTS
Magnequench International, Inc., a manufacturer of specialized magnetic powders and magnets, filed suit in U.S. District Court in Indianapolis, Indiana on July 14, 2004 against Microsoft (as well as Philips) alleging that Microsoft's Xbox infringes Magnequench's U.S. Patent Nos. 4,851,058; 4,802,931; and 4,902,361< on its magnetic powders.
"Since we filed our original suit, we have had many good and positive discussions with manufacturers and retailers who indicate they are taking steps to better police their supply chains. The defendants have told us they are opposed to infringing our patents and are willing to work with us. In fact, already many of our customers have told us they are regaining business they had once lost to infringing materials due in large part to pressure applied by some defendants," said Archibald Cox, Jr., President and Chief Executive Officer of Magnequench, which holds the patents to Nd-Fe-B magnets which were developed by General Motors in the early 1980s.
This case is in addition to 14 other lawsuits Magnequench has filed against other parties, all of which are manufacturing firms in the United States and Asia.
